These Terms of Use govern your access to and use of the app and related services provided by The Duck App ("The Duck App," "we," "us," or "our"). By creating an account, accessing, or using the app, you agree to these Terms.
Using the App
You may use the app only in accordance with these Terms and applicable law. You are responsible for your use of the app and for activity occurring through your account.
Your Account
You are responsible for maintaining the security of your account and for providing accurate information where required. You may not impersonate another person, create accounts for fraudulent or abusive purposes, share access in a manner that compromises account security, or attempt to gain unauthorized access to another user's account or information.
License Plates and Vehicle Information
The app may allow users to associate license plate information, vehicle information, QR codes, or similar identifiers with an account. You represent that you are authorized to submit, use, or associate information you provide through these features.
You may not use these features to impersonate another user, falsely claim another vehicle, harass or track another person, obtain unauthorized information, or otherwise use vehicle information for an unlawful or abusive purpose.
Collections and Virtual Items
Ducks, Duck Bucks, crates, achievements, rewards, and other virtual items are features of the service. Except where otherwise required by applicable law, virtual items do not represent money, property, a financial account, or an ownership interest in The Duck App or its assets.
Access to virtual items is provided through the service and does not constitute a sale or transfer of ownership of the underlying software, artwork, intellectual property, or other app content.
Purchases
Purchases, Duck Bucks, crates, and other paid or virtual items are additionally governed by our Purchase Terms , which form part of these Terms of Use.
Gifting and Trading
The app may allow eligible virtual items to be gifted or traded between users. Gifting and trading features may be subject to eligibility rules, limits, restrictions, availability, or changes. Certain ducks or other virtual items may be designated as non-giftable or non-tradeable.
We do not guarantee the availability, value, rarity, desirability, or future transferability of any virtual item.
No Real-Money Marketplace
Unless expressly authorized by us, users may not use the service to buy, sell, exchange, wager, or otherwise transfer virtual items, accounts, or app benefits in exchange for real-world money or other things of monetary value.
We may restrict activity reasonably believed to involve an unauthorized marketplace, fraudulent transaction, commercial exploitation, or other misuse of the service.
Acceptable Use
You may not use the app to engage in fraud, harassment, threats, abuse, unlawful conduct, unauthorized commercial activity, infringement of another person's rights, manipulation of app systems, exploitation of bugs, interference with other users, or attempts to compromise the security, integrity, or operation of the service.
Automated and Abusive Activity
You may not use bots, scripts, automation, exploits, unauthorized software, modified clients, or other methods to manipulate collections, rewards, Duck Bucks, crates, gifting, trading, achievements, accounts, or other app features.
Errors and Corrections
We may investigate and correct account balances, virtual items, rewards, achievements, transactions, or other account information resulting from technical errors, duplicate grants, fraud, exploits, unauthorized activity, or abuse, subject to applicable law.
Changes to the Service
The Duck App may modify, update, add, remove, rebalance, restrict, suspend, or discontinue features of the app as the service evolves, subject to applicable law.
This may include changes to collections, virtual items, rewards, achievements, gifting, trading, functionality, pricing, availability, technical requirements, or other aspects of the service.
Service Availability and Discontinuation
We do not guarantee that the app, its servers, or any feature of the service will remain available indefinitely or operate without interruption. The service may be interrupted, suspended, modified, or discontinued in whole or in part.
If the service is discontinued, accounts, collections, ducks, Duck Bucks, crates, achievements, rewards, and other virtual items or account data may become inaccessible or may be deleted. Use of the app does not create a right to permanent operation of the service, permanent maintenance of an account, or permanent access to virtual items or account data.
Any rights to refunds, notice, data access, or other remedies remain subject to applicable law and applicable platform policies.
Account Suspension and Termination
We may restrict, suspend, or terminate access to the app when we reasonably believe an account has violated these Terms, abused the service, engaged in fraudulent or unlawful activity, infringed the rights of another party, or created a security or operational risk.
Suspension or termination may result in loss of access to account features, collections, virtual items, or other account information, subject to applicable law.
Account Deletion
You may request deletion of your account through the account deletion features provided by the app. Account deletion may permanently remove account information, collections, virtual items, progress, and other associated data, except information that The Duck App is permitted or required to retain.
Our Intellectual Property
The app and its software, original artwork, graphics, branding, designs, interfaces, text, features, databases, and other content provided by us are owned by or licensed to The Duck App and are protected by applicable intellectual property and other laws.
Except for the limited right to use the service in accordance with these Terms, no rights in this intellectual property are granted or transferred to you.
Third-Party Trademarks and No Affiliation
The Duck App is an independent service and is not affiliated with, associated with, authorized by, endorsed by, sponsored by, or in any way officially connected with FCA US LLC, Stellantis N.V., Jeep®, or any of their respective parents, subsidiaries, affiliates, licensors, dealers, or other related entities.
Jeep® and any other third-party names, trademarks, service marks, logos, vehicle names, product names, and brand identifiers referenced in connection with the service are the property of their respective owners. Any reference to a third-party brand or product is intended solely to identify or describe relevant vehicles, products, communities, or subject matter and does not imply sponsorship, endorsement, authorization, or affiliation.
No third-party trademark owner is responsible for The Duck App, its operation, its content, its virtual items, its purchases, or transactions or interactions occurring through the service.
Third-Party and Licensed Content
Certain ducks, artwork, brands, promotions, products, or other content may be provided in collaboration with or under license from third parties. Availability of such content may be limited, changed, or discontinued in accordance with applicable agreements, rights, and legal requirements.
The inclusion of third-party content does not grant users any ownership or other rights in the trademarks, copyrights, or intellectual property of those third parties.
Third-Party Services
The app may depend on or interact with third-party platforms, app stores, payment systems, hosting providers, authentication providers, networks, devices, or other services that we do not control.
To the maximum extent permitted by applicable law, The Duck App is not responsible for the availability, operation, security, terms, policies, or independent actions of third-party services.
Feedback
If you voluntarily provide ideas, suggestions, comments, or other feedback about the app, you agree that The Duck App may use that feedback to develop, improve, promote, or operate the service without restriction or an obligation to compensate you, subject to applicable law.

Disclaimer of Warranties
To the maximum extent permitted by applicable law, the app and its services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory.
To the maximum extent permitted by law, The Duck App disclaims implied warranties including merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the service will always be available, secure, accurate, uninterrupted, error-free, or free from harmful components, or that defects will always be corrected.
Limitation of Liability
To the maximum extent permitted by applicable law, The Duck App and its affiliates, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, consequential, or similar damages arising out of or related to your access to, use of, or inability to use the app or service.
This includes, to the extent permitted by law, loss of data, loss of access, loss of virtual items, loss of goodwill, or other intangible losses. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless The Duck App and its affiliates, officers, employees, contractors, licensors, and service providers from claims, liabilities, damages, losses, and reasonable costs and expenses arising from or related to your violation of these Terms, your unlawful or abusive use of the service, your infringement of another person's rights, or information or content you submit without appropriate authorization.
Events Beyond Our Control
To the maximum extent permitted by applicable law, The Duck App is not responsible for delays, interruptions, or failures caused by events reasonably beyond our control, including failures of networks, hosting services, app stores, third-party platforms, utilities, telecommunications systems, natural disasters, government actions, labor disputes, widespread outages, or other similar events.
Changes to These Terms
We may update these Terms as the app, our business, applicable law, or the services evolve.
When appropriate, we may provide notice of material changes through the app or by other reasonable means. We may require you to affirmatively accept updated Terms before continuing to use some or all of the service. Continued use after updated Terms become effective may constitute acceptance where permitted by applicable law.
Severability
If any provision of these Terms is determined to be invalid, unenforceable, or unlawful, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
No Waiver
Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision in the future.
Assignment
You may not assign or transfer your rights or obligations under these Terms without our consent. The Duck App may assign or transfer its rights and obligations in connection with a merger, acquisition, reorganization, sale of assets, operation of the service by another entity, or as otherwise permitted by law.
Entire Agreement
These Terms, together with the Privacy Policy, Purchase Terms, and any other policies or additional terms expressly incorporated into them, constitute the agreement between you and The Duck App governing your use of the service with respect to the matters they address.
